These Terms of Service govern your use of surgeops.dev and any services provided by SurgeOps ("we", "us", or "our"), operated by Shahar Mendi. By accessing this website or engaging our services, you agree to these terms.

1. Services

SurgeOps provides DevOps consulting and infrastructure services including but not limited to: cloud infrastructure setup and optimization, Kubernetes deployments, CI/CD pipeline implementation, observability stack setup, and ongoing infrastructure retainers.

The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate written agreement or statement of work agreed upon by both parties prior to commencement of work.

We treat all client information, systems, credentials, and business details as strictly confidential. We will not disclose your information to third parties without your written consent, except as required by law.

Any confidentiality or NDA requirements beyond this standard clause should be specified in the engagement agreement.

5. Intellectual Property

Upon full payment, all custom work product created specifically for your engagement (scripts, configurations, documentation) becomes your property. We retain the right to use general knowledge, skills, and non-proprietary techniques gained during the engagement in future work.

7. Limitation of Liability

Our liability for any claim arising from our services is limited to the amount paid for the specific engagement in which the claim arose. We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or business interruption.

We strongly recommend maintaining current backups before any infrastructure changes are performed.

8. Warranties

We warrant that services will be performed in a professional manner consistent with industry standards. We do not guarantee specific uptime percentages or performance outcomes unless explicitly stated in the engagement agreement.

9. Termination

Either party may terminate an engagement with written notice as specified in the individual agreement. Upon termination, you remain responsible for payment of all work completed up to the termination date.

10. Governing Law

These terms are governed by the laws of Israel. Any disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Tel Aviv, Israel.

11. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
